By booking the African Safari Yoga Adventure and paying your deposit you are agreeing to the following terms and conditions.
Tour Provider
You acknowledge and understand that the African Safari Yoga Adventure is provided by Neil Urry trading as Soul Safari Retreats (ABN 64071347353)
Frieda is attending this tour to provide the yoga and mindfulness activities on the itinerary. All other tour inclusions are provided by or arranged by Neil Urry/Soul Safari Retreats.
The non-refundable tour deposit is collected by Frieda Yoga, Pilates & Hiking Trust (ABN 66 828 617 847). All other tour fees payable by you are payable to Neil Urry.
Soul Safari Retreats Terms & Conditions
Neil’s terms and conditions are as follows.
The tour package starts and ends in South Africa as described in the specific tour itinerary.
Inclusion: Everything described in the invoices. (See also What You Get page of the information brochure)
Exclusion: International and domestic airfare, some meals not described in itinerary, drinks, optional activities, all personal expenses, taxes, excess baggage, Visa fee (where applicable), Passport cost, and travel insurance. Single traveller accommodation surcharge. (See also What You Get page of the information brochure)
Travel insurance: All travellers should be covered by travel insurance prior to departure. Insurance details must be supplied to us at least 4 weeks before departure.
Payments: Instalment payment is due on the date specified in the payments schedule below, unless there is a special arrangement. All prices are in Australian Dollars and valid at time of publication, but are subject to change as explained below. We strive to make our best efforts to ensure our prices do not change, but we might be required to impose surcharges depending on currency fluctuations, changes in government legislation, unexpected airline price change, fuel surcharges or other events beyond our control. We will contact you with updated prices before the full payment is made.
Payment schedule: Non-refundable deposit of AUD$599 within 7 days of booking. The balance* will be required to be paid in full 4 months before departure date. *If you are having single room occupancy AUD$1650 will be added to your balance and can be added to the payment plan instalment amount. Suggested payment plan based on the SUPER EARLY BIRD rate will be AU$1000 on the following dates 31st July 2023, 31st September 2023, 31st November 2023 and 28th February 2024. EARLY BIRD rate 4 payments of $1050 (dates to be arranged) REGULAR rate 4 payments of $1100 (dates to be arranged).
Cancellations or amendments by traveller: All cancellations must be received in writing. Cancellations are subject to the following cancellation fee applied per person, per confirmed booking: (a) For cancellations made more than 90 days before the scheduled tour departure date, the deposit will be forfeited to us. (b) For cancellations made between 46 to 89 days before the scheduled tour departure date, a cancellation fee of 50% of the tour costs will be payable. (c) For cancellations made within 45 days of the scheduled tour departure date, 100% of the tour costs will be payable. Cancellation of any third-party suppliers’ arrangement will be subject to fees charged in accordance with the supplier. Refund will not be given for unused or cancelled services after your arrangement have commenced. Amendment fees are not charged to the traveller unless we are charged by the third party. Additional amendment charges may be charged by suppliers such as airlines and hotels. Your individual travel insurer may be consulted for assistance.
Cancellations or amendment by us: We reserve the right to cancel, reschedule or amend any itinerary items in accordance with operating requirements or circumstances beyond our control.
Limited liability, Claims and Exclusions: Neil Urry as the provider to you of services, as a travel agent and/or a tour operator guarantees to you that those services will be provided to you with due care and skill, be reasonably fit or for their specified purpose, can be reasonably expected to achieve the desired result and will be provided to you within a reasonable time having regard to the circumstances. If we breach any of these guarantees, then you may have rights under the Competition and Consumer Act 2010. Where we are liable to you under that Act then our liability is limited. To the fullest extent permitted by law, you release us from any liability to you for any loss, theft or damage to baggage or property, or for any injury, illness or death whether any such is caused by the negligence of us or not. We are not liable to you for any loss, theft or damage to baggage or property, or for any injury, illness or death howsoever caused or arising directly or indirectly from accidents, loss, theft or damage to person or property delays, transport failure, strikes, third parties, wars and uprisings or acts of God or nature over which we have no control. We strongly urge all customers to undertake a high level of personal responsibility in order to ensure that possessions, equipment and personal documents are closely monitored and protected at all times.
Feedback and publicity: We strive for continuous improvement and value your feedback. After the tour, we will ask every traveller to participate in a feedback sheet or a telephone/meet in person interview. We will use this information only for improvement of our quality of service. You agree that we may use images of you taken on tour and any comments by you regarding the tour for publicity and promotion purpose.
Waiver of Liability - Frieda Yoga & Hiking
By registering for the African Safari Yoga Adventure you agree and understand that you are participating in this event at your own risk and that any physical activity involves a real risk of physical injury. You take full responsibility for your own medical fitness to participate in this tour. You understand that Frieda Orr trading as Frieda Yoga & Hiking (ABN 73391098986) is not the provider of this tour and is instead contracted by the tour provider only in relation to the yoga and mindfulness inclusions.
By registering for the African Safari Yoga Adventure you agree to fully release and indemnify, and keep indemnified, Frieda Orr trading as Frieda Yoga & Hiking (ABN 73391098986) and the Frieda Yoga, Pilates & Hiking Trust (ABN 66 828 617 847) (Indemnified Parties) from and against all claims, actions, demands, suits, proceedings, damages, liabilities, losses or costs (without limitation) made or brought against, suffered or incurred by the Indemnified Parties arising in any way from, or in connection with, your participation in the African Safari Yoga Adventure. Your indemnity of the Indemnified Parties extends to personal injury, illness, delay, loss or damage to property or health that you suffer or incur in connection with your participation in the tour.
Frieda’s Terms & Conditions
Law: This Agreement is governed by the laws of the State of Western Australia and all parties shall comply with all laws, regulations and rules of Western Australia.
Photos & Film: I agree for any photos and/or film, which may be taken during activities, to be used in Frieda’s marketing and promotion.
Non-refundable deposits: Deposits are not refundable in any circumstances. However, if you are unable to attend, you may be able to transfer your deposit to a friend who wishes to attend in your place. Requests for transfers must be made in writing to frieda@frieda.com.au. Frieda retains discretion to determine whether transfer of deposit will be allowed in the precise circumstances that arise.
Consequential losses: It is hoped that should we ever have any differences, we could be able to work them out through a conversation or email correspondence. However, should a dispute ever arise between us, you agree now that the maximum remedy that may be provided to you by Frieda Orr trading as Frieda Yoga & Hiking (ABN 73391098986) or Frieda Yoga, Pilates & Hiking Trust (ABN 66 828 617 847), in any circumstances, is the amount of your tour deposit. You agree that no award of consequential or indirect losses, loss of profits, loss related to third party payments or of any other type of damages may be granted to you as a remedy for any dispute.
Non-Disparagement: In the event of a dispute between you and Frieda Yoga & Hiking, you agree to not engage in any conduct or communications, public or private, designed to disparage the African Safari Yoga Adventure, Frieda Orr or Frieda Yoga & Hiking.
By registering for the African Safari Yoga Adventure you are acknowledging that you have read, understand, agree to and accept all of the terms in this Agreement. You understand that you may also be required to sign a physical copy of some or all of these terms and conditions prior to departure for this tour.
